(As Investigated By Jean Taylor-Todd and Told To Liz Zukowski On May 21, 2012) Two Big Mortgage Frauds: MERS and Tranche Insurance Payoffs MERS stands for “Mortgage Electronic Registry Systems,” and was started in 1997 by the big banks to help expedite the quick buying and selling of loans. They are found in 65 million mortgages across the US, about 60% of all American loans. You may find them in your mortgage chain of title posing as either the nominee mortgagee or in an assignment of your deed of trust, which is recorded at the Register of Deeds office where your property is located. They are strictly a registry system with NO authority to buy and sell a note; and it appears they VOID your note if they appear ANYWHERE in your mortgage transaction. The mortgage/deed of trust cannot be separated from the note (US Supreme Court, 1872, Insurance v. Eldredge.) They are incorporated in Delaware and have offices in Reston, VA and in Flint, Michigan. They are currently being investigated and sued in various parts of the country, including New York, Florida, and in North Carolina by Jeff Thigpen, Register of Deeds in Guilford County. Their appearance in your chain of title causes your loan to be based on fraud. If you have not already been foreclosed on, it could be a legal basis for rescinding the loan. The organization, ALEC (American Legislative Exchange Council) is attempting to introduce legislation that would legalize the fraud already committed nationwide by MERS. Their membership list is not public, but their shareholders include Bank Of America, Fannie Mae, and Freddie Mac. The US government is aware of their misdeeds, but homeowners have to sue them individually or as part of a class action suit to nullify your note. In NC, you may be able to get your property and title back, everything you paid on the note and loan costs, $250,000 in punitive damages, and additional treble damages under the Unfair and Deceptive Trade Practices Act (NCGS Chapter 75). During the height of the housing bubble, loans were being bundled (pooled) in groups called tranches and insured. It appears if one borrower defaulted in any one group of loans that the insurance company then PAID OFF ALL THE LOANS IN THAT GROUP. The same loan could have been bundled in several groups and paid off on multiple occasions, but the bank never bothered to tell you! Uninformed homeowners could be fighting foreclosure on a home loan that was long ago paid! To prove that money never exchanged hands when MERS came into your loan transaction, or to find out if your loan was already paid off by an insurance company, you would have to subpoena the ORIGINAL LOAN FILE in a legal proceeding. Loan files are usually kept in a locked vault if they have not been lost altogether. (IF lost, you may prevail on voiding the foreclosure because the original note is required in NC.) ANOTHER HELPFUL TIP: Remember, if the interest in the note was never legally transferred to anyone, the “pretender lender” can’t lawfully take your property because there is NO proof of the existence of a VALID debt, as required by NCGS 45-21.16. The combination of heavy chemical fertilizers and herbicides used on the soil damages soil fertility and thus the nutrition content of the food. How do GMOs harm the environment? GMOs increase herbicide use. These herbicides are toxic to people and animals and are increasing in levels in soils, water, and our bodies. GMOs cause super weeds and super bugs to develop that become tough to manage. GMO pollen can cross pollinate with other crops leading to pollution of the organic crops and our food heritage. By patenting GMOs and selling patented seeds, corporations can exert more and more control of our food and grow their profits until they control the entire food supply. In fact, US government is promoting GMOs here and in other countries. So is the Gates Foundation. What crops and food are GMO? Soybeans, corn, cotton, alfalfa, Hawaiian papaya, canola, sugar beets, rice (coming soon), zucchini – arrrgh!! This means that almost any processed food contains GMO content. What can we do? Push for labeling, avoid GMO foods, educate your friends and family, push for the end of corporate personhood, find alternatives to fast food, let restaurants you frequent know your preference for real food. By: Roger Ehrlich A 20 foot pop-art “Leaning Lady Liberty” statue, which had become one of the symbols of Occupy Raleigh and was a familiar site to downtown Raleigh motorists, was stolen from the corner of Edenton and West Streets between Friday, May 18 afternoon and early Saturday, May 19 morning. “The statue belonged to all of us,” said Occupy supporter Roger Ehrlich, who helped create it, “I know people loved it, and not just the occupiers. They would lean out their car windows to take pictures, a local artist painted a picture of her standing in front of the tents. Now it’s been stolen, just like people’s Constitutional Rights and economic security have been stolen.” The statue showed civilians attempting to resurrect a leaning Statue of Liberty in a formation reminiscent of another iconic image, the statue of U.S. Marines planting a flag at Iwo Jima. It was featured in a recent News 14 story about the closing of the resource center. The owner of the property said the statue could stay at least through the end of May. Citizens have erected a sign where the “Leaning Lady Liberty” used to stand and distributed handbills with her image in the hopes that the community can help get her back. Two harassing phone calls received at 3:30 and 4:00 a.m. Monday, May 21 by an Occupy Raleigh participant suggest that the statue may have been stolen by opponents of the movement. “A lot of people are disturbed with what’s been happening with financial fraud, the wars, and how corporate money rules,” said Ehrlich, “but people have different ideas about what should be done. We’ve gotten some opposition from people who claim to be patriots, and with recent events like veterans in Chicago returning their medals to protest the wars and fraud I know emotions are running high. We don’t know who took it, but I’d like to ask those people, ‘do they hate the dissent that has spread liberty throughout the world? Do they hate freedom?” Raleigh supporters of the Occupy Wall Street movement began by occupying space at the State Capitol last fall, but their claims of the right to 24 hour public assembly and speech at the square fell on deaf ears and they were forced to move temporarily to the private but visible location downtown. When occupiers shut down the resource center where the statue stood, they vowed to redirect their energy into other efforts such as instituting new limits on corporate political influence and holding those guilty of financial crimes accountable.
